07/28/2010 California DIR Requires Electronic Certified Payrolls

7/28/2010 California Department of Industrial Relations to Require Submission of Electronic Certified Payrolls Beginning August 1, 2010.

NOTE:  After lengthy delays, electronic certified payroll submission went into effect January 2012 for construction projects funded with State bond money.

Beginning August 1, 2010 contractors working on public works construction projects in California will find that they are subject to the regulations of the Public Works Compliance Monitoring Unit (CMU) – part of the California Department of Industrial Relations – in accordance with State Senate Bill X2-9, that was signed into law in February 2009.

California Compliance Monitoring UnitThe CMU will conduct the required monitoring and enforcement of the states public works prevailing wage laws on specific state bond funded and/or design-build procurement construction projects undertaken by public entities in California and awarded on or after the effect date of the regulations – August 1, 2010.

TRS Consultants/Hill InternationalThe bottom line is that you will need to electronically file your certified payroll reports (rather than submit a paper form) using an independent on-line or internet based Labor Compliance Program (LCP), which has been developed by TRS Consultants, Inc. (now owned by Hill International, Inc.).

NOTE: We have been providing TRS Consultants, Inc. compatible files since 2004 and foresee no issues ahead.  We are in contact with both the CMU and TRS Consultants, Inc. at this time to see if there are any special/additional requirements.


Many of you are already familiar with how CPS can automically create the necessary file(s) which are required by the various Labor Compliance Programs - for you, it will simply mean that you will select the "Standard XML Export file (TRS Consulting)" from the Electronic Upload Type drop down menu.

NOTE:  As of March 1, 2013 the California Compliance Monitoring Unit will be discontinuing the use of the MyLCM System.  Certified Payroll Reports must be submitted via pdf's.  More information to come.
