New Jersey Certified Payroll Major Changes 10-2019

Earlier this year, New Jersey Governor Murphy enacted the Diane B. Allen Equal Pay Act an gave the actual certified payroll reporting form an overhaul. 

Now, the New Jersey Department of  Labor (NJDOL), Division of Wage and Hour Compliance has made major changes to the Statement of Compliance.  Among the changes to the form, there is now a section (table) requiring that where the fringe benefit due employees is paid to approved plans, funds or programs (rather than to the employee in cash), contractors must MUST indicate which part of the total fringe benefit amount was paid to each of the following plans/funds/programs:

  • health/welfare,
  • vacation/holiday,
  • apprenticeship/training,
  • pension
  • and "Other" - which you are required to explain. 

The form also requires that for each plan/fund/program, the contractor must include the hourly rate paid,  the name and address of the fund, plan or program administrator, the USDOL benefit plan filing number or EIN, and any third-party trustee and/or contact person. 

No other state (to date) requires contractors to submit THIS MUCH information.

This has caused us to pretty much do a TOTAL rewrite of Certified Payroll Solution (CPS) for New Jersey and we have worked non-stop since the end of September when we were notified of this change by a customer.

For everyone:

  1. Backup your CPS data.  Backup & Restore menu --> choose Enhanced Backup --> make sure a back up folder is specified --> Backup.
  2. Update CPS to the MOST current version.  Help menu --> About --> click the BIG "Login" button.  Download and install the current CPS setup.

THEN....get ready to do the setup.

Setup instructions have proven difficult - because how you set Certified Payroll Solution up to handle this latest change DEPENDS on HOW you pay your fringes.  So, instead off writing a "mini-manual" that you have to sift through - we've provided video training for specific ways in which you might pay your fringe benefits.  

Video training is free.  There is no way that we can provide one-on-one training with each of our customers.  Therefore, if you desire one-on-one training for the required setup, please purchase a 2 hour training contract for $230.00 from our order page.

 

How do I know which video I should watch?

We've tried very hard to spell that all out for you.  From the bullet list below, read the options for HOW fringe benefits might be paid by your company and then watch the videos (listed also on this page).

  • For non-union contractors paying the FULL fringe benefit in CASH to the employee AND checking BOX 4(b) WHERE FRINGE BENEFITS ARE PAID IN CASH on the Statement of Compliance - watch video 1 belowOnce you've done that you're all set.  Run your reports.

 

  • For non-union contractors paying the FULL fringe rate to one or more plans BUT fringe rates vary by job
    • AND you just want to "dump" the balance of the fringe into a SUB PLAN or PENSION PLAN
    • AND you are checking box 4(a) WHERE FRINGE BENEFITS ARE PAID TO APPROVED PLANS, FUNDS OR PROGRAMS
    • Watch videos 2 & 3 below in that order

 

  • You are a non-union contractor paying PART of the FULL fringe rate into one or more "plans" AND there is a balance that is paid in CASH to the employee
    • AND you are checking BOTH boxes 4(a) WHERE FRINGE BENEFITS ARE PAID TO APPROVED PLANS, FUNDS OR PROGRAMS AND 4(b) WHERE FRINGE BENEFITS ARE PAID IN CASH
    • Watch videos 2 & 4 below in that order

 

  • For Union contractors paying the FULL fringe to the Union Hall
    • AND you are checking box 4(a) WHERE FRINGE BENEFITS ARE PAID TO APPROVED PLANS, FUNDS OR PROGRAMS
    • Watch videos 2 & 5 below in that order

NOTE: While we have extensively tested, there may be issues.  If you encounter an issue - please document EXACTLY what you did and EXACTLY WHAT the problem is and submit it to Support at SunburstSoftwareSolutions dot com. 

Be sure to check that you have the MOST current version of the software from the Help menu --> Check for updates. Issues and corrections will be documented in the Release Notes section on the download page as things progress.

 OTHER THINGS TO NOTE:

The original Statement of Compliance page from NJDOL included the fringe benefit table on the same page as all the legal wording - we tried, but were unable to duplicate this and make it so you would still be able to read it.  We then contacted Kevin Triplet, Section Chief of Public Contracts [(609) 292-2259], explained the situation and we were told that they are willing to accept modifications as long as ALL the information is presented in a similar fashion.  And he was agreeable to us putting the Benefit program information table on a separate page.  We even emailed him a sample of what we planned to do.

When you print this form there will be a minimum of 3 pages - the actual certified payroll report, the legal wording for the Statement of Compliance AND THEN one more pages of the Fringe Benefit table.

The Fringe benefit table is NOT available to preview.  You will need to actually print the report.
